Employer E informed us they had just been told they would be winning a contract to carry out services at a new customer’s site. The previous contractor had employed 5 staff members at that site to work on the customer’s contract. We advised of the TUPE implications relating to a service provision change, including the need for consultation and the requirements of the outgoing contractor to provide employee liability information. We drafted the relevant letters for Employer E to send to the affected employees and the outgoing contractor, as well as advising on the process to be followed.
